Section 1Identification of the provider
Nidovo is a digital service owned by:
KorynLabs S.L.
Tax ID (NIF): B23895097
Address: Carrer d'Emili Juncadella, 36, 08950 Esplugues de Llobregat, Barcelona, Spain
Contact email: privacy@nidovo.com
Website: https://www.nidovo.com
In these terms, the expressions "Nidovo", "KorynLabs", "we" or "the provider" refer to KorynLabs S.L.
Section 2Purpose and scope
These terms govern access to and use of the Nidovo public website and, when available, of its apps and private features.
Nidovo is a platform intended to organise, preserve and share memories, photographs, documents and other family information through private spaces and permission systems.
The availability of each feature depends on its stage of development, the version of the service and, where applicable, the plan purchased.
The publication of information about a future feature does not mean that it is already available, nor does it in itself constitute a contractual offer.
Section 3Territorial scope
Nidovo is aimed at users in the European Union.
KorynLabs S.L. is established in Spain. The provision of the service will respect the mandatory provisions applicable to consumers and users in the relevant Member States.
Technical access to the website from other territories does not necessarily mean that Nidovo offers or markets its services there.
Section 4Access to the website
Access to Nidovo's public pages is, as a general rule, free and does not require creating an account.
Private features may require registration, authentication, an invitation to a family and acceptance of the corresponding conditions.
Visitors must use the site lawfully, respect its security measures and refrain from any activity that impairs its operation.
Section 5Registration and accounts
When registration is enabled, Nidovo access accounts are intended for people over 18 years of age.
Each user is responsible for providing accurate information, protecting their credentials and reporting any unauthorised access.
It is not permitted to use another person's identity, to share credentials in order to circumvent access controls or to access information without authorisation.
Nidovo may offer different authentication methods, including third-party services, when they are enabled.
Section 6Family spaces
Nidovo allows information to be organised through private family spaces.
A person may belong to several families, provided that they have the necessary authorisations or invitations.
Each family keeps its own members, roles and permissions. Belonging to one family does not grant access to the information of others.
Family content does not become public merely because it has been added to Nidovo.
Section 7Administrators and permissions
Administrators manage the composition of the family and the powers of its members within the options offered by the service.
Only adult members with permission to manage profiles can create and manage child profiles. By default this applies to the family's owners and adults, and owners can adjust those permissions.
Other adult members may view, add or interact with information according to the permissions assigned to them.
Being an administrator does not in itself prove parental authority, guardianship or legal representation of other people.
When an administrator is the last one in their family, they must first transfer the administration to another eligible person before leaving it, in accordance with the available features.
Section 8Child profiles
Nidovo allows authorised adult members to create family profiles relating to minors.
Child profiles are not user accounts. Minors do not currently have their own credentials or independent access to the app.
Profiles may include identifying data, photographs, relevant dates, memories and other family information added by authorised adults.
Anyone who adds information about a minor must have sufficient legal entitlement to do so, act proportionately and respect the minor's rights, including those relating to privacy, personal image and data protection.
The creation of a profile does not automatically prove that the administrator is the legal representative of the minor, nor does it replace any authorisations that may be necessary.
Nidovo may review requests, restrict access or adopt proportionate measures where there are indications of unlawful use of minors' information or significant conflicts over their rights.
Section 9Privacy of family content
Family spaces are configured as private environments.
Access to each item of content will depend on the applicable permissions and features.
Users must respect the confidentiality of family information and avoid disclosing it outside the authorised environment.
Before adding photographs, documents or other data about third parties, they must check that such use is lawful and respects the rights of the people concerned.
Section 10Content added by users
Users retain the rights they hold over the content they add.
By using Nidovo, they authorise KorynLabs S.L., on a non-exclusive basis and limited to what is necessary, to store, technically reproduce, synchronise and display that content to authorised members in order to provide the service.
This authorisation does not constitute a transfer of intellectual property.
KorynLabs does not acquire ownership of family memories, nor is it authorised by this clause to sell, publish or exploit them for advertising purposes.
Anyone who adds content must hold the necessary rights and authorisations.
Section 11Prohibited conduct
It is not permitted to:
- Use Nidovo for unlawful activities.
- Access accounts, families or systems without authorisation.
- Impersonate other people.
- Add content that infringes the rights of third parties.
- Disclose personal data without legal entitlement.
- Use the platform to harass, threaten or discriminate.
- Introduce malicious code or attempt to compromise the security of the service.
- Circumvent technical limitations or permission controls.
- Add or disseminate content that harms the rights or safety of minors.
Nidovo may adopt proportionate measures in the event of breaches, in compliance with applicable law.
Section 12Free features and future subscriptions
Nidovo includes free features and subscription plans.
As of the effective date of these terms, subscriptions are announced for information purposes only and are not offered for purchase through the public website.
Prices, capacities and features that may be displayed before purchasing is enabled are for information purposes only, unless expressly stated otherwise.
Before allowing a paid purchase, Nidovo will provide the specific economic and contractual terms required by applicable law.
Section 13Future payment methods
Nidovo plans to use Stripe for web payments and may offer subscriptions through the Apple and Google platforms.
The mention of these providers does not mean that all payment channels are operational as of the publication date of these terms.
When they are enabled, information will be provided before purchase on the responsible trader, the total price, taxes, billing frequency, renewal, payment methods, cancellation and the corresponding statutory rights.
Section 14Cancellation and plan changes
Where paid subscriptions exist, ordinary cancellation will prevent further renewals and will allow the purchased features to be kept until the end of the period already paid, unless a different statutory right applies.
Switching to a lower plan will not in itself result in the automatic deletion of existing memories and content.
Where the new plan has lower limits, new additions or operations exceeding those limits may be restricted.
The specific conditions will be communicated before purchase and will respect the mandatory rights of consumers.
Section 15Right of withdrawal and consumer rights
When Nidovo allows paid services to be purchased at a distance, it will recognise the applicable rights of withdrawal under the applicable law.
As a general rule, European legislation provides for a period of 14 calendar days to withdraw from certain distance contracts, subject to its conditions and statutory exceptions.
The start of the provision of a digital service does not automatically imply loss of the right of withdrawal.
Before purchase, specific information will be provided on how to exercise it, the applicable exceptions and, where relevant, the consequences of requesting that the service begin immediately.
Nothing in these terms limits the statutory guarantees of conformity of digital content and digital services.
Section 16Availability and maintenance
Nidovo will endeavour to keep its services available and secure, although interruptions may occur due to maintenance, updates, technical incidents or causes beyond its reasonable control.
Features may evolve in order to improve the service, correct errors or meet security and compliance requirements.
Where a change affects the contractual rights of consumers, the legally required guarantees and notices will be respected.
Section 17Security and suspension
KorynLabs may apply proportionate restrictions or suspensions where there are justified grounds relating to security, fraud, unauthorised access, serious breaches or legal obligations.
Where appropriate, information will be provided about the measure and the complaint channels.
These actions do not exclude the statutory rights of the people concerned.
Section 18Account closure and deletion
Users may delete their account from the app or request its closure by writing to privacy@nidovo.com.
A proportionate identity check may be requested in order to prevent fraudulent access or deletion.
Account closure and the deletion of personal data will be handled in accordance with the Privacy Policy and applicable legal obligations.
Deleting an account does not necessarily mean the automatic destruction of all content shared with other members of a family.
Section 19Shared content and leaving a family
When a person leaves a family, content legitimately shared with other members may be kept, provided that there is an appropriate lawful basis and the rights of the people concerned are respected.
Requests for erasure, objection or restriction will be assessed individually.
The retention of a shared memory does not automatically prevail over the data protection rights of the people represented in it.
Section 20Intellectual and industrial property
Nidovo, its name, visual identity, software and proprietary content are protected by intellectual and industrial property law.
Access to the service does not confer ownership rights over these elements.
Their use is permitted only to the extent necessary for the legitimate use of Nidovo.
Content provided by users is governed by section 10.
Section 21Third-party links and services
The site may contain links to third-party services.
KorynLabs does not control the terms of all external sites and recommends consulting their respective policies when accessing them.
The inclusion of a link does not necessarily imply a commercial relationship, endorsement or responsibility for their content.
Section 22Data protection
The processing of personal data is described in the Privacy Policy.
The storage technologies of the public site are explained in the Cookie and Local Storage Policy.
Acceptance of these terms does not replace the specific consents that may be legally required.
Section 23Liability
KorynLabs S.L. will be liable under the terms established by applicable law.
Users are responsible for the lawful use of their accounts, permissions and content.
No provision excludes liability that cannot be limited by law or restricts the mandatory rights of consumers and users.
Section 24Changes to the terms
These terms may be updated to reflect legal, technical or functional changes.
Significant changes will be communicated appropriately and with the notice required where they affect existing contracts.
Where fresh acceptance is required, it will be requested before the relevant change is applied.
Section 25Governing law and jurisdiction
These terms are governed by Spanish law, without prejudice to the mandatory consumer protection provisions applicable in each person's Member State of habitual residence.
Disputes will be submitted to the competent courts in accordance with applicable law.
Consumers are not required to waive any rights or forums to which they are legally entitled.
